NICE & the Cancer Drugs Fund – politics based medicine

It has been reported that Health Secretary, Andrew Lansley, is to alter the powers of the National Institude for Clincial Excellence (NICE) so that it cannot turn down new medicines for use on the NHS.  NICE was set up to provide an evidence based approach to healthcare advice and take often difficult drug funding decisions so that NHS healthcare is as equal as possible.  According to The Guardian:

The health secretary, Andrew Lansley, believes that Nice, the National Institute for Health and Clinical Excellence, should continue to write guidelines for doctors on the best treatments for their patients, but the Guardian understands he will remove its controversial power to ban the use of drugs it considers too expensive for the benefit they offer.

This is a hugely significant change as it could allow influence from patient lobby groups, pharmaceutical companies or newspaper headlines to undermine evidence based treatment decisions.  It is difficult to predict the outcome of any such change directly, especially as scarce detail is available of checks and balances one would assume would play a part.  However, we can look at how politicians use healthcare funds that are independent of NICE as a model to hypothesise about the future.  One such fund is the Cancer Drugs Fund, set up by recently by the Conservative and Liberal Democrat coalition government:

A Cancer Drugs Fund of £200 million a year to help cancer patients get greater access to cancer drugs that their doctors recommend for them was confirmed today by Health Secretary Andrew Lansley.The announcement follows the Coalition Government’s commitment to create a Cancer Drugs Fund to commence from 2011 to help thousands of patients get increased access to innovative new cancer drugs that extend life or improve quality of life. Following the Spending Review, £200 million a year in funding will be available for cancer drugs from April 2011 to the end of 2013.

In addition to this commitment, £50 million has been available since 1 October, until the end of March 2011, with clinically led panels now set up in each region. These panels put doctors in charge of deciding how this funding is spent for their patients locally, together with advice from patients’ cancer specialists.

The government have claimed that this fund will increase cancer survival rates.

we would save 5,000 lives a year. If we were to achieve cancer survival rates at the European best, we would save 10,000 lives a year.

The Department of Health (DoH) were asked ‘if this costing has been assessed by NICE, if not could you indicate if it has been subjected to external scrutiny by another body?‘. The reply:

The Department has not asked the National Institute for Health and Clinical Excellence (NICE) or any other external body to assess its costings

However information was provided on the reasoning behind the claim about survival rates:

As background information, we are not suggesting that the £164 million investment will result in a specific number of lives saved. We have said that we will aim to save between 5,000 and 10,000 cancer patients’ lives each year – 5,000 by bringing England in line with the European average and 10,000 by bringing survival rates in England in line with the best in Europe.
Increase detection through a revolutionary new bowel cancer screening technology flexible sigmoidoscopy (FS) – a£60 million investment over the next four years to incorporate the latest breakthrough in bowel cancer screening into our existing national programme – saving 3,000 lives a year. A randomised controlled trial funded by Cancer Research UK, the Medical Research Council and NHS R&D took place in 14 UK centres between 1994 and 2010, and evaluated screening for bowel cancer using a single FS between 55 and 64 years of age, removing small polyps by FS and providing colonoscopy for patients with high risk polyps.

The study reported in The Lancet in April 2010 and concluded that FS is a safe and practical test and, when offered only once between ages 55 and 64 years, confers a substantial and long-lasting benefit. The report showed that men and women attending a one-off FS screening test for bowel cancer can reduce their mortality from the disease by 43% (31% on a population basis) and reduce their incidence of bowel cancer by 33% (23% on a population basis)[1]. Based on these figures, the programme would prevent around 3,000 cancers every year ( FOB testing has never been shown to reduce the incidence of bowel cancer).

The Lancet paper can be found here and its findings are reported accurately by the DoH, however they omitted that the research found that ‘the numbers needed to be screened to prevent one colorectal cancer diagnosis or death, by the end of the study period, were 191 (95% CI 145—277) [for rectum cancer] and 489 (343—852) [for sigmoid colon cancer].‘. To save 3,000 lives ~2,000,000 people would have to be screened. Given that £60m is earmarked for this fund then the approximate costs per person screened would be ~£30. There is no recent data for the costs of the procedure, but a 2003 paper found as follows:

The health service costs of a flexible sigmoidoscopy was estimated at £56. The total costs of screening (including private costs) averaged £82 per person screened, although costs varied by center. The total health service costs of screening and subsequent management averaged approximately £91 per person screened, again with variations between centers.

Perhaps there has been a massive fall in prices since this paper was published, otherwise this money cannot possibly achieve the desired outcome. The private sector cannot be seen as an alternative as it offers the procedure at £650 – £1,075 according to some estimates.

The DoH also claim that they will:

Provide cutting-edge cancer therapies , through our commitment to invest £50 million in additional cancer drugs this year. The Rarer Cancers Foundation has estimated this would benefit over 2,000 cancer patients this year alone. The Rarer Cancers Foundation (RCF) is a charity set up to

draw together people with rare and less common cancers, thereby giving them a bigger collective voice to exact better services, and enabling them to support one another;
make all health professionals aware of issues related to rarer cancers, such as the often slow diagnosis and the need for successful treatment and symptom control pathways to be shared;
work with the Government, the NHS and Primary Care Trusts/Health Boards to ensure that people with rarer cancers have access to the best possible services across the United Kingdom.

While their report is not peer reviewed it does come from a charity claiming to represent patients who might normally struggle to be heard and it is right that politicians and civil servants pay attention to it. In particular they want the government to pay for more cancer drugs sooner.

Despite our strong support for the commitment in the Coalition’s Programme for Government, we were, however, concerned that the potential benefits the proposed Cancer Drugs Fund would bring to patients would be unnecessarily delayed by a year to April 2011, resulting in thousands more patients being denied the treatments they need. To put the pressing nature of the issue in context, to date NICE has rejected, or announced that it is minded to reject, 10 cancer treatments since the 6 May 2010 alone. A full list of the NICE appraisals published since the General Election is included in Annex 1.
The RCF therefore wrote to the Prime Minister on 19 July 2010 to ask him to bring forward the introduction of the fund.

Below are the sources of funding for the RCF from their last accounts.  The careful reader might note that not only is almost all of their funding from drug companies, but that many of those companies manufacture the drugs that the RCF want the government to pay for, against the advice of NICE.

The RCF is undoubtedly a lobby group whose interests align with those of its funders, the pharmaceutical industry.

If the Cancer Drugs Fund is to be used as a model for predicting the impact of the proposed changes to NICE then Lansley’s reforms are problematic.  The fund has not only got its sums wrong, but is swayed by lobbying from pharma funded charities disgruntled at evidence based assessments declining the products of said funders.  I hope that opposition politicians and members of the government committed to evidence based healthcare oppose these plans, the consequences of failing to do so could be disastrous.

The seed for Thanatopolis was planted in 1983. It was an emotional response to the frustration of I-Park’s founder with the available options offered by the cemetery, funeral home and monument dealer upon the death of a loved one. There had to be a more fulfilling way to honor a special individual in one’s life upon their passing. And, it was felt, there needed to be a greater role for creativity and personalization in this process.

International Stem Cell and Absorption Systems Confirm Results Showing Stem Cell Derived Corneal Tissue as an Alternative to Animals for Drug Testing

Other Tests Show Tissue's Ability to Focus Light, Pointing to Potential Therapeutic Applications

OCEANSIDE, Calif. – May 10, 2010 – International Stem Cell Corporation (OTCBB: ISCO), http://www.internationalstemcell.com/, the first company to perfect a method of creating human "parthenogenetic" stem cells from unfertilized eggs, announces the results of a second set of experiments confirming that its lab-grown corneal tissue closely mimics the drug absorption and drug metabolism characteristics found in normal corneal tissue. Other tests show that the stem cell derived corneal tissue refracts light, thus providing a further indication of its potential therapeutic value in treating corneal injury and disease.

Two sets of collaborative experiments between ISCO and Absorption Systems have now shown that corneal tissue cultured by ISCO exhibits topical drug absorption barrier properties and tissue-appropriate enzymatic activity, making it a promising model for studying human ocular drug absorption as an alternative to live animal testing. ISCO's human corneal tissue is created in the laboratories of its wholly owned subsidiary, Lifeline Cell Technology (Walkersville, MD).

In a second set of tests conducted by a third party expert, a beam of diverging light was projected through the corneal tissue from different distances, becoming more or less refracted with the changing distance, showing that the corneal tissue was clear and had optical properties that allow the focusing of light. Additional experiments will be conducted to better define these optical characteristics.

According to Jeffrey Janus, Senior VP of ISCO and CEO of Lifeline, "We are very excited to confirm our initial results showing drug absorption that correlates with animal models and add to these results the observation of enzymatic activity. This not only advances our plans to manufacture a product that can be used to reduce the need for tests that use living animals, but it also is one more step toward the potential therapeutic use of this tissue as a treatment for human corneal injury or disease. This has implications, not only in the US, but also in India and Asia, where millions of people suffer from corneal blindness that now goes untreated. The experiments showing light refraction are a tempting indication that this tissue will have therapeutic application."

Ofquack to regulate herbal medicine?

The attempted regulation of herbalism looks doomed to failure with a clear difference of opinion between government and practitioners, the latter prefer statutory regulation which has been rejected as an option by government.

Last week the Department of Health (DoH) recommended that the Complementary and Natural Healthcare Council (CNHC/Ofquack)  regulate herbal medicine, traditional Chinese medicine (TCM) and acupuncture.  Minister for Health, Andy Burnham, said:

“Emerging evidence clearly demonstrates that the public needs better protection, but in a way that is measured and does not place unreasonable extra burdens on practitioners.

“I am therefore minded to legislate to ensure that all practitioners supplying unlicensed herbal medicines to members of the public in England must be registered with the Complementary and Natural Healthcare Council (CNHC).

The CNHC have expressed their pleasure at this announcement:

CNHC is pleased to be asked by The Secretary of State for Health to register practitioners supplying herbal medicines to members of the public in England.

The Council already registers a significant range of practitioners in complementary healthcare who meet its standards and is well positioned to expand its public protection role in this way. Since 2008 CNHC has established its reputation as a regulatory body with robust and effective standards for registration and fitness to practise. It has positive and collaborative links with the statutory healthcare regulators.

This is probably regarded as good news by the CNHC, they have had a well documented struggle for funding and have trouble attracting some of the more popular forms of quackery.   Regardless of this, the CNHC are not fit for purpose, they have recently told sceptical blogger Simon Perry that they will not consider his complaints for the next 6 months:

I began making complaints to the Complementary and Natural Healthcare Council about reflexologist members who happily promote their bogus treatments despite the fact that there was not a jot of evidence to support them.

The CNHC has now informed me that for the next six months, they will no longer be processing any complaints that are similar to the ones I’ve submitted. By similar, I take this to mean complaints regarding practitioners who mislead their clients by making unjustifiable or false statements, including practitioners who have already been cautioned by the CNHC for doing it before.

The CNHC was set up under the aegis of Prince Charles’ Foundation for Integrated Health (FIH) to be a self-regulatory body for alternative health, now it is one that is not prepared to regulate.  However this is not unexpected.  Organisations purporting to regulate quackery rarely do so beyond upholding the doctrines and articles of faith of the respective field of quackery, managing risks to consumer health are generally not a priority.

It would be a concern for those with an interest in exposing the practices of alternative medicine if the CNHC were to regulate herbal medicine, traditional Chinese medicine and acupuncture.  This, despite the recommendations of Andy Burnham, is unlikely to happen for two reasons.

1) The government is unlikely to exist in its current form within a month or two.  A general election is expected early in May and the Labour party are unlikely to win, if they are to remain in power it will be in a coalition but it is more likely that the next government will be formed from the Conservative party.  None of the major parties have a clearly stated policy on the regulation of alternative medicine, nor is it likely to be a major election issue, so the Department of Health’s current proposals are likely to be mothballed for some considerable time.

2) Herbalists  and TCM practitioners do not want CNHC regulation.

This latter point is the most important.  The European Herbal & Traditional Medicine Practitioners Association (EHTMPA), the Register of Chinese Herbal Medicine (RCHM), the Association of Traditional Chinese Medicine (ATCM), and the National Institute of Medical Herbalists (NIMH) amongst others in the alphabetical smorgasbord that represents the various denominations of herbalism, have all campaigned for statutory regulation.  Their intent was to be regulated by the Health Professionals Council (HPC), a more serious organisation than the CNHC, that regulates practitioners in proven fields of health.  This statutory regulation would confer protected status on their profession, restricting the title of Herbalist to those regulated by its rules.

By and large these organisations are disappointed with the DoH’s announcement:

the CNHC (the proposed regulator) was formed to regulate complementary health practitioners on a voluntary basis, and as currently constituted, is not equipped for statutory regulation.

the government seems to have failed to deliver its promise, and has changed its mind from HPC as our regulatory body to CNHC. We would like to demand an explanation from the government on what ground it has changed its mind, as CNHC is only a voluntary body with no statutory power. From the rather short DH press release which lacks details, we doubt whether the government still wants to introduce statutory regulation, or decides to go for an alternative.

Herbalists should be regulated like other statutory regulated healthcare practitioner or, the public will lose access to properly regulated herbalists and a wide range of herbal medicines. The Government must give detailed assurances that the legal and structural basis of statutory regulation is fit for purpose or it will betray the millions of people who regularly consult herbal practitioners. So far the Government has singularly failed to provide these guarantees.

As the CNHC is voluntary these organisations have no need to insist that their members sign up, in fact as they are holding out for statutory regulation it is unlikely that they will be willing to express any support for the CNHC, to do so would undermine their campaign.  This will damage the CNHC’s longterm viability, no new members means no new funding sources, and with the homeopaths mired in infighting the herbalists represent their last decent chance of acquiring new members in the medium term.

This is good news for those that are concerned about poor practice in alternative medicine.  The collapse of the CNHC will further damage the reputation of alternative medicine.  Hopefully a new government will take stock of the intransigence of the herbalists, the infighting of the homeopaths and the inability of the CNHC to regulate and instead apply a more robust external form of regulation for quackery.
